Judge Allows First Amendment Lawsuit Against Miami Beach Mayor

U.S. District Judge Cecilia Altonaga denied a motion to dismiss the case filed by Raquel Pacheco, a veteran and Miami Beach resident. The dispute centers on a January 12 incident where two officers arrived at Pacheco’s home to question her regarding a Facebook post that criticized Meiner’s support for Israel’s military campaign. Altonaga ruled that ordering a police visit to a private home to address an individual’s speech could constitute a restriction on protected expression, potentially supporting a viewpoint discrimination claim.

Evidence in the case indicates that Meiner personally flagged the post to law enforcement, labeling it a "dangerous escalation," while later characterizing Pacheco’s comments as "age-old antisemitism" during public remarks. Video footage from the interaction shows police informing Pacheco she was not under arrest, yet explicitly instructing her to "refrain from posting things like that" to prevent others from becoming agitated. The ruling also allows the American-Arab Anti-Discrimination Committee to pursue claims that the city engaged in a broader pattern of suppressing pro-Palestinian speech, citing instances where officials cut off public comments from activists while granting more time to those expressing opposing views.
