The petition, filed by Martinez on October 1, alleges that Berry verbally berated their son and physically restrained him during a dispute over a video game in late September. Martinez claims he was alerted to the situation via a panicked phone call from the boy, leading him to seek sole legal and physical custody. In response, Berry’s attorney, Marina Beck, characterized the filing as a predictable escalation from a man with a documented history of volatile behavior. Beck maintains that Martinez frequently violates existing court orders and is using these allegations as a distraction.
While a Los Angeles County judge granted a temporary restraining order requiring Berry to maintain a 100-yard distance from her ex-husband and son, the court rejected Martinez’s request for immediate psychiatric evaluations and substance abuse testing, citing insufficient evidence. The judge did, however, restrict the actress’s visitation schedule to specific days of the week. The former couple, who finalized their divorce in 2023 after a protracted eight-year separation, are set to return to court on October 16 to address the merits of the restraining order.
