The complaint, captioned Hatweek v. Fluence Energy, Inc. et al., claims that Fluence executives misrepresented the company’s capacity to capitalize on data center demand. While the energy storage provider previously assured shareholders of its readiness to fulfill orders through multiple production facilities, the lawsuit alleges these sites were either incomplete or non-operational. This discrepancy between guidance and reality reportedly led to a series of sharp declines in share price throughout 2026.
The initial collapse occurred on February 5, 2026, when shares dropped from $28.99 to $18.95 following the disclosure of significant project costs and a net loss of $62.6 million. Subsequent updates in August and September, which forced the company to slash revenue and EBITDA guidance due to ongoing production delays, caused further market erosion. Investors now have until November 27, 2026, to apply to the U.S. District Court to serve as lead plaintiff in the action, which asserts violations of the Securities Exchange Act of 1934.
