The policy paper asserts that AI is an inherently interstate phenomenon with significant national security implications, arguing that state laws could conflict with broader federal strategies for global dominance. The administration suggests that states should be prohibited from penalizing developers for third-party misconduct or placing undue burdens on AI usage that would otherwise be legal.

Public Citizen co-president Robert Weissman labeled the document a hollow effort, noting that it provides no meaningful federal standards while effectively stripping states of their ability to act. Critics, including Rep. Don Beyer (D-Va.) and Rep. Yvette Clarke (D-NY), echoed these concerns, with Clarke describing the framework as being written explicitly by and for Big Tech interests. Brad Carson of Americans for Responsible Innovation warned that the move mirrors the lack of oversight seen in the social media era, predicting that preventing localized guardrails will lead to long-term regulatory failure.
